Notary

Category: Financial & Legal

Introduction

A notary in Quebec, also referred to as a civil-law notary or a notary public, is a lawyer of voluntary private civil law.  His or her functions include the drafting, taking and recording of legal instruments for private parties, as well as providing legal advice.  A notary is vested as a public officer with the authentication power of the government.

Real Estate Transactions

A notary has an instrumental role in a real estate transaction.  For the buyer, the process of purchasing a property is complex and is composed of many steps; from signing the promise to purchase and having an inspection done, to obtaining a mortgage and a deed of sale.  Throughout this process, a notary's expertise in real estate law can be relied upon to provide advice and guidance.
